NJDEP Regulation Update

Amendments to the NJ Flood Hazard Area Control Act Rules and Stormwater Management Rule became effective on July 17, 2023. These regulatory changes were adopted in response to NJDEP’s Protecting Again Climate Threats (“PACT”) initiative. This first round of PACT regulatory changes increase the extent of State-regulated flood hazard areas associated with non-tidal (fluvial) waterbodies, increase volumes of stormwater that must be accommodated in stormwater management design, and are likely to have broad implications for development across the State.

The next PACT regulatory proposal will impact NJDEP land use regulations governing development in coastal areas, tidal flood hazard areas, and freshwater wetlands.
